Acceptance of these terms

These Terms & Conditions govern your use of the Target Momo House website and any orders, reservations or other transactions you make through it. By using the site you agree to these terms. If you do not agree, please do not use the site.

We may update these terms from time to time. Continued use of the site after changes are posted means you accept the revised terms.

Website usage

• You must be at least 18 years old, or have the consent of a parent or guardian, to place an order or make a reservation.
• You agree to provide accurate, current information and to keep your contact details up to date.
• You may not use the site to transmit malicious code, attempt to gain unauthorized access, scrape content at scale, or interfere with its normal operation.
• All content on this site — text, photography, logos, menus and design — is owned by us or our licensors and may not be reproduced without permission.

Online ordering

An order placed through the site is an offer to purchase. It is accepted only when the restaurant confirms it. We may decline an order if an item is unavailable, the delivery address is outside our zone, we cannot verify your details, or we reasonably suspect fraud.

• Accuracy — please check your order carefully before submitting. We prepare exactly what is on the ticket.
• Timing — quoted preparation and delivery times are estimates and may be longer during peak hours or bad weather.
• Delivery — we deliver within roughly four miles of each location. Delivery fees and minimums are shown at checkout. Someone must be available to receive the order.
• Allergens — our kitchen handles wheat, soy, sesame, egg, dairy, shellfish and tree nuts. We take precautions but cannot guarantee an allergen-free preparation.

On this demonstration site, no orders are transmitted, processed or fulfilled.

Reservations

• Reservation requests are confirmed by email or text and are not guaranteed until confirmed.
• Tables are held for 15 minutes past the reserved time, after which we may release them.
• Parties of nine or more may be asked for a card to hold the booking and are subject to a per-guest fee for cancellations made with less than 24 hours' notice.
• We may seat partial parties or ask you to wait if not all guests have arrived.
• A gratuity may be automatically added for parties of eight or more.

Payments and pricing

• All prices are shown in US dollars and exclude applicable sales tax, which is calculated at checkout based on the fulfilling location.
• We accept major credit and debit cards and approved digital wallets in-store. Payment is taken at the time of ordering for online orders.
• Prices, menu items and availability may change without notice. If an item becomes unavailable after you order, we will contact you to substitute or refund it.
• Obvious pricing errors do not bind us; where one occurs we will contact you before proceeding.

Cancellations and refunds

• Before preparation begins — call the location promptly and we will cancel and refund in full.
• Once preparation has begun — we generally cannot cancel, since food is made to order.
• Something wrong with your order — contact us within 24 hours with your order number and we will remake the item, credit your account or refund it, at our discretion.
• Refund timing — approved refunds are issued to the original payment method and typically appear within five to ten business days.

Promotions and offers

• Promotions cannot be combined with one another unless expressly stated.
• Offers exclude alcohol, gratuity, taxes and delivery fees unless stated otherwise.
• Student discounts require a valid, in-date student ID presented at the time of ordering.
• We may modify or withdraw any promotion at any time, including for suspected abuse.
• Momo Club credit has no cash value, is non-transferable and may be forfeited if the account is inactive for 24 months.

Gift cards

• Gift cards may be redeemed at any of our locations for food and beverages.
• Gift cards do not expire and are not redeemable for cash except where state law requires it.
• Lost or stolen cards can be replaced only if you have the original receipt or card number.
• Gift cards may not be used to purchase other gift cards.

Your responsibilities

• Treat our staff and other guests with respect. We reserve the right to refuse service to anyone behaving abusively, and to ask them to leave.
• Supervise children in the dining room for their safety and everyone else's comfort.
• Tell us about allergies and dietary requirements before you order, not after.
• Do not leave items unattended; we are not responsible for lost or damaged personal property.
• If you post reviews or photographs referencing us, do so honestly and without misrepresenting your experience.

Disclaimers and limitation of liability

The website is provided "as is" and "as available." We do not warrant that it will be uninterrupted, error-free, or that content such as menus and prices is always current.

To the fullest extent permitted by law, our total liability arising out of or relating to these terms or your use of the site is limited to the amount you paid for the order giving rise to the claim. We are not liable for indirect, incidental, special or consequential damages.

Nothing in these terms limits liability for fraud, death or personal injury caused by negligence, or any other liability that cannot be excluded under applicable law.

Governing law and disputes

These terms are governed by the laws of the State of New York, without regard to conflict-of-laws principles. Any dispute will be brought in the state or federal courts located in New York County, New York, and you consent to their jurisdiction.
